Welcome to Historic Edenton, North Carolina, the South's "Prettiest Small Town!"
Edenton Bay Plantation is a gated, residential, waterfront community located on the Albemarle Sound less than 3 miles from Edenton. The property was developed by Timberline, LLC after purchase from the Wood's, a prominent Edenton family. Lot sales began in 1999. There are approximately 116 lots ranging from 2/3 acre to nearly 3.5 acres in size.
Since 2001, the Edenton Bay Plantation Homeowner's Association (EBP HOA) has managed the development, including the common areas, roads, pier, etc., as well as approved all building plans and covenant enforcement. Currently, there are 20 occupied homes in the development, with 5 under construction and approximately 2 others with approved building plans.
ABOUT EDENTON
Edenton is a small town (pop. 5,000) in the Northeast Coastal Plain of North Carolina. Founded in 1722, it has been an important commercial area and port for North Carolina, serving as capital for many years during the Colonial period. The town has preserved its character impeccably, with architecture from all of the major periods from Colonial up through post-Victorian. This work has attracted the attention of magazines such as Southern Living and Architectural Digest. In addition, the downtown is still a thriving concern, with a variety of businesses, ranging from an old fashioned hardware store to a gourmet food and wine shop. When asked why they are considering a move to Edenton, most people say that it reminds them of their hometown when they were young, before strip malls and big box stores took over. Its called the "Mayberry Factor." Edenton is not a museum, however. It is still a working town, with 90%+ occupancy of downtown buildings. Agriculture and related business is still king, with tourism and retirement development catching up quickly. Pleasure boat manufacturing is the only major industry in the county. Edenton is served by Chowan Hospital, a small branch of University Health Systems of Eastern NC (based at Pitt/East Carolina University Center in Greenville). The fire and rescue squad, which serves Edenton and the southern half of Chowan County, is a mixture of volunteer and paid staff. College of the Albemarle, a 2 year community college based in Elizabeth City, has a satellite campus in Edenton. For more information on Edenton, please go to the Town of Edenton web site.

CHANGES IN THE COUNTY SETBACK RULES
There has been some confusion recently concerning the new side setback rules for Chowan County. The county has determined that all residential lots in the county that are more than 15,000 square feet but less than 40,000 square feet (known in zoning parlance as R-15) will CONTINUE to have a 12-foot side setback for all structures other than driveways, fences, etc. Lots of 40,000 square feet or more (aka R-40) should have a side setback of 15 feet. Most of the lots in EBP are R-15. Most of the lots in Mallard's Cove are R-40. To determine the square footage of your lot, find the exact acreage on the plat, your deed, or your survey map if you have one. Multiply this number by 43,560. The result is the square footage of your lot. The Chowan County Planning Department will grant exceptions for unusual shaped lots or others that absolutely cannot meet these requirements. DELINQUENT DUES
The following are delinquent on their annual dues for 2006-2007:

If dues or any other monies owed to the HOA are not paid by the due date, they become delinquent and the property for which the money is owed is subject to a lien from the HOA. In addition to the monies owed, a $25 adminstrative fee as well as compounded interest at the rate of 1/2% per month may be added to the amount owed.
WEB SITE CHANGES
To streamline the web site, all protected information has now been moved to the restricted site. This includes approved meeting minutes, financial statements, email addresses for members, and archives. You may have to enter the username and password more than once until all the bugs are worked out.
ADDRESS CHANGES?
The HOA makes every effort to ensure all mailings get to you in a timely manner, but the burden is on the lot owner to notify the HOA of address changes. The HOA will not be responsible if a mailing does not get to you on time due to your not reporting address changes to the HOA. Please notify the HOA of any address changes, physical or email.
WASHINGTON COUNTY SELECTED FOR NAVY PRACTICE FIELD
The US Navy, in its final Environmental Impact Statement, has recommended Washington County as its candidate for the Outer Landing Field (OLF), where pilots will practice touch-and-go landings. The planes will be stationed Oceana Naval Air Station in Virginia Beach and Cherry Point. Edenton Bay Plantation is only 25 miles from the proposed site, and could be in the flight path from OLF to Oceana. The entire region opposes the idea, since the area will reap minimal economic benefits from the plan. Those benefits will remain in Virginia Beach and Cherry Point, while the Albemarle region gets the noise and pollution. Additionally, 30,000 acres of productive farm and forest land will be removed from the tax rolls. Washington and Beaufort Counties (actual location of the field) are adamantly opposed to the site. Chowan County is mixed in its opinion.
UPDATE
The B.R.A.C. has given Virginia Beach and Chesapeake an ultimatum: Stop developing around Oceana and buy real estate in the highest crash probability zone. The estimated cost for the real estate is $250 million, which does not include Lynnhaven Mall, which is in the crash zone. Virginia has 6 months to show "significant" progress in the matter, or Oceana will be scheduled for closing. Virginia has made some tentative steps, including changing zoning for some properties. However, the leadership in the area has stated that they cannot declare imminent domain, and will not do anything to lessen property values. They are also balking at making land purchases.
The Navy appealed Judge Boyle's decision to uphold a restraining order on any work associated with the OLF to the US Appellate Court in Richmond. The Appellate court ruled that the Navy did not do a complete study on the impact of the OLF on migratory birds who winter in the adjacent Pocosin Lakes National Wildlife Refuge. However, the Navy can resume negotiating land purchases in the core area and do other preliminary work on the site.
NEW DEVELOPMENT PROJECTS IN THE ALBEMARLE REGION
SANDY POINT
The largest development ever planned for Chowan County will apparently be coming to the Sandy Point area (either side of NC 32 near the Albemarle Sound Bridge). Approximately 927 acres of farm, forest and swampland has been purchased by The Fund For New Urbanism. LLC of Miami, Florida and was then transferred to a subsidiary called the Fund for Sandy Point, LLC. They plan to build approximately 1,000 units on the property for retirees and vacation home purchasers over the next 10 years. All developable land along the sound from Edenton to the Sound Bridge (NC 32) has now been slated for development (Edenton Bay, Edenton Bay Plantation, Cape Colony, Country Club Place, Mulberry Hill, and Sandy Point).
The plans include digging a large inlet and canals to maximize waterfront opportunities. State law was changed to allow this to occur. The area to the west of NC 32 (closest to EBP) would be more dense, less costly development, including town homes and patio homes, with the area to the east being estate-type homes on larger lots. The architecture will be strictly monitored, with lot purchasers choosing among a handful of pre-approved designs. They would like to include retail and office space in the development, but understand the limited appeal of this area to young professionals and are cognizant of the effect on the established trade in Edenton. More than likely, the area would resemble Albemarle Plantation, although a golf course is not currently planned.
The development will use City or Albemarle Electric power and county water, but plans to build its own sewage treatment facility. The Fund For Sandy Point foresees the community incorporating into Chowan's second official town. They have held several public meetings and have had a favorable response from local citizens, newcomers, and Edenton/Chowan officials. UPDATE: Sandy Point has been fully approved. Site work should commence no later than this fall, with lot sales beginning by Spring 2008. Over the next 10-15 years, Chowan County stands to gain nearly $1 billion in additional taxable real estate from this development alone.
COLONIAL VILLAGE
This is the first new subdivision within the town limits of Edenton in over 20 years. It is located on Coke Avenue, near the old veneer mill. Construction on this 120 lot, 20 acre subdivision is well under way. Approximately 2 dozen homes are already occupied, and at least 10 more are under construction. These "starter" home prices are from $180,000. The developer plans to have all of the homes built within 2 years.
HAYES PLANTATION
The Wood family, owner of Hayes Plantation and former owners of EBP and Edenton Bay, have been granted rezoning for their entire property (minus their home and a small section of farm) from Agriculture/Residential to Residential/Commercial. This land completely surrounds EBP, and includes the recent cutover behind the garbage site, and fields next to Pelikan Vinyl on NC 32. They envision housing of varying density, including town homes, patio homes, and estate homes, along with "light" commercial development mostly along NC 32 and Soundside Rd. The original plan was denied, but an updated plan has been approved.
INNSBROOK
RJ Reynolds has sold approximately 1,000 acres of its Avoca Farms holdings on the Chowan River and Albemarle Sound in Bertie County for development. Innsbrook will have an Arnold Palmer Signature golf course with approximately 450 estate size homes. The developer has built an 8,000 square foot home for himself in the development area. Construction on the golf course has begun, and all lots have been sold.
ALBEMARLE PLANTATION
Albemarle Plantation has received approval to expand by approximately 1,500 living units. They intend to have mixed residential (single family, patio, townhouses) and light commercial (bank, general store, restaurant, etc.) in the new phase.
EDENTON COMMONS SHOPPING CENTER
A proposal for a new shopping center, to be anchored by the upscale, Virginia-based Farm Fresh grocery chain, has been tentatively approved after much heated debate, including the removal of a member of the Planning Board. The center would be on Whitemon Lane, across the street from Albemarle Motor Company, next to US 17 bypass. The planned 45,000 square foot Farm Fresh would be more than double the size of either of the 2 current chain grocery stores in Edenton. A total of 173,000 square feet of retail space is planned. The developer has stated that he will not allow any business that would directly compete with local, downtown Edenton businesses. No "big box" store will be located there. An opening in Summer 2007 is planned, but site work has not begun as of 12/2006.
UPDATE: Due to the aquisition of Farm Fresh by another company, the opening date for Edenton Commons is now scheduled for Spring 2008. There is an unsubstantiated rumor that the opening was delayed pending the approval of Sandy Point.
MORE DEVELOPMENT
Two more developments have been presented to the Planning Commission for approval. A 55 year old and older community has been submitted for the land adjoining and just south of Pembroke Creek off of West Queen Street. Approximately 500 units are to be constructed, including single family homes, townhouses, and condominiums. Another development has been submitted that would be situated between NC 32 North and Paradise Road (behind the Duck Thru station). Each of these developments is at least partially within town limits. The major concern is that the current water supply is not large enough to handle the added need.
Another large development has been approved on Drummond's Point Road along the Yeopim River. An approximately 700 acre tract of timberland formely owned by International Paper was sold in early 2006. The development will contain approximately 1,000 single family homes, its own sewage treatment facility, and even its own electric company. Site work commenced in Fall 2006.
UPDATE: The 55 and older community has been put on hold due to concerns about traffic, water availability, and the proposed gated status of the community.
